City Council Meeting Minutes Apr. 25, 2017

Minutes of Fairview City Council Meeting held on Tuesday, April 25, 2017, at 7:30 p.m. at 85 South State Street, City of Fairview, County of Sanpete, State of Utah.

Mayor Jeff Cox called the meeting to order at 7:30 p.m. Council members present were Bawb Nielsen, Cliff Wheeler, Casey Anderson, KaeLyn Sorensen, Bob St. Jacques. City employees present were Dave Taylor, Justin Jackson, Greg Sorensen, Bob Bingham, Cliff Keller, and Jan Anderson. Citizens present were Tara Anderson, Caden Madsen, Zander Bertola, Seth Howarth, Christian Klunker, Jeff Jarman, Mike Jarman, Roman and Erma Lee Aaron, and Matt Sorensen.

City Employee Dave Taylor offered the invocation and led the Pledge of Allegiance.

APPROVAL OF MINUTES:

Councilman Cliff Wheeler moved to approve the minutes from March 28, 2017, Councilwoman KaeLyn Sorensen seconded the motion. The voting was unanimous in favor of.

APPEARANCES/COMMUNICATIONS:

Jeff Jarman – Sanpete Food Pantry Donation. Last council meeting, Mr. Jarman had asked the Council for a $1,500 donation for the pantry. The Council tabled their decision until this meeting. Mr. Jarman went back to the board, they refigured what we needed. They are hoping for $750.00. Councilman Cliff Wheeler stated he would be support $500. Councilman Bawb Nielsen stated he would be willing to go $750. Mayor Jeff Cox recommended that the City contribute $500 this fiscal year and then in July when the next fiscal year begins to pay the additional $250. Councilman Bob St. Jacques moved to approve the $750 donation with $500 paid in this fiscal year and the additional $250 be paid in July. Councilman Casey Anderson seconded the motion. REPORTS/ACTION ITEMS – BOARDS/COMMITTEES/STAFF/OFFICERS:

Power Department.

Substation Bid Update. Four bids were received on the substation project.

They are as follows: Bodec – $387,700, Wasatch Electric – $827,302, Codale Electric – $330,527, and RME – $371,700. Codale Electric Supply came in low bidder and was awarded the project. There are some additional costs, those being an addendum submitted for a block wall for the transformers at $2,700, trenching/relocating lines into the City for an additional $100,000. Funding will be done inhouse without having to bond. Things will be tight for a few years. Will borrow from other funds and overtime pay them back. Codale is six weeks out for engineering to take place. It is a six- month project.

Cemetery Irrigation Project Update. Mayor Cox updated the City Council on the progress at the cemetery. One problem the City deals with is when the irrigation company turns the water off to the city, the debris flows to the end of the line which is the cemetery line. It creates havoc with the filter. The irrigation company worked with the City to help with this problem. They agreed to provide the valve if the City would provide the box. When it came down to it, the irrigation company just moved their valve further downstream. The real problem is the filter is in adequate. The sprinkler heads are the size they use at a golf course. Sprinkler companies no longer make gear driven heads. They have a micro filter in them now. With the sediment in the water, the filters plug real fast. A new four-inch filter has been installed at the same location down by the Sanpitch River below Michael Craven’s home. The City is unable to produce an agreement for an easement on the location of the filter. Mayor Cox visited with Mr. Craven. He is willing to work with the City this year to get a feel on how the location of the filter will affect his property and family. If things don’t work out this year, the filter may have to be moved. There are more sprinklers that need to be replaced. Hydro-seeding should start this coming Friday. Flowers should be taken off the graves the Monday following Memorial Day.

July 24th Update. Dates and times of events were handed out to the Council. Councilwoman KaeLyn Sorensen will be meeting with the chairs next Wednesday, she would like to buy them dinner for all they do for the celebration. The following are the dates and times of events: July 10-11th – 10 a.m. to 4 p.m. Lace Days; July 14th – 5:30 p.m. all night volleyball tournament, 6 p.m. Horseshoe tournament; July 15th – 7 a.m. softball tournament, golf tournament; July 18th – 7 p.m. Ice Breaker; July 19th -ATV Rodeo; July 20th – 4 p.m. youth tennis tournament, 7 p.m. kids rodeo; July 21st – 6 p.m. horse parade, 7:30 p.m. rodeo; July 22nd – 7 a.m. adult tennis tournament, 8 a.m. ATV Drive for Food, 7 p.m. Derby, 10 p.m. fireworks, July 23rd – 6:30 p.m. DUP program; July 24th – 6 a.m. fireman’s wakeup, 6:30 a.m. fun run, 7 a.m. flag ceremony, 10 a.m. craft fair, 10:15 a.m. kids motorized parade, 10:30 a.m. kids walking parade, 11 a.m. Pioneer Day parade, noon – EMT barbecue , 1 p.m. car show, 1 p.m. Fairview idol, and 1 p.m. kid’s games.

Recreation Tax Discussion. The tax is a local sale and use tax of .1 percent. It is a tax to help fund botanical, cultural, recreational, and zoological organizations or facilities. City Recorder Jan Anderson explained the process which the City must go through to put the opinion question on the ballot for the citizens to approve or not approve. Councilman Casey Anderson and Chair Mike Jarmen from the recreation committee with work with Jan to move this process forward. Councilman Bob St. Jacques moved to proceed with this local sale and use tax for recreation purposes. Councilman Casey Anderson seconded the motion. The voting was unanimous in favor of.

Sport’s Park and Recreation Update. City Planner Dave Taylor stated he had applied for grant where the City will have to raise the match. The committee came up with ideas and will move with them. This fall the City will hear whether they received the grant or not. The project will have one year to complete the project. The Rec committee is wanting to have a blurb put in the Focus asking for citizens to contribute a couple dollars. If they were willing to help in this way, the dollars would add up fast.

Seasonal Part-time Update. Mayor Jeff Cox briefed the Council on the part-time help for the summer. There were three who applied. Hired all three. Their hours will be kept a minimum. After Memorial Day, the need to keep all three will be assessed and, if there is a need for all three, all three will be kept. Their names are Kyler Swapp, Wendie Peterson, and Wayne Shepherd.

Discussion on Charitable Donation Cap. Council Bob St. Jacques wanted to reiterate that the Council needs come to some sort of a balance on the donations. There is a sense of compassion but the issue is that the City needs to make ends meet on the cost of the building and the wear and tear.   Need to bring numbers to budget meeting next month. May want to look at having a maximum balance or an allotted amount per entity.

INTRODUCTION AND ADOPITION OF RESOLUTIONS AND ORDINACES:

Ordinance No. 2017; An Amendment to the Fairview City Zoning Ordinance, “A Land Use Ordinance of Fairview City”, Ordinance No. 2008-01; Amending Part B, Chapter 17, Animal Control. The Planning Commission made modification per the City Council’s recommendation from last meeting. More clarity was added on the ¼ acre and the fees. Councilman Bob St. Jacques moved to approve the amendments made to Chapter 17, Animal Control of the Fairview City Zoning Ordinance. Councilman Cliff Wheeler seconded the motion. COUNCIL REPORTS:

Mayor Jeff Cox – General City Business Update. The purchase of the approved backhoe was made. It will take a couple of month before it arrives. JBC is the company. The cost is approximately $78,000. They will finance it for three years with yearly payments. Not sure on the rate, still waiting on the paperwork. It could be around 3.7 percent. There is a five-year warranty.

Councilman Bawb Nielson had a couple of people ask to use the dance hall for an autism fund raiser. They are planning on doing this weekend. Would like to waive the fee at the dance hall. Would the Council be okay with waiving the fee? There are two autistic kids who are attending a school in American Fork. Mary Cox and Kendra Cox both have a child in this school. They are raffling off items and selling items. It was suggested that people get sponsors to help them with the cost of the building. Not sure if the money raised goes back to the school or to offset their cost. The Council would like to have someone report back to them next month on the event. At that time, it will be decided if the Council will waive the fee.

Councilman Cliff Wheeler wanted to thank Chief Bob Bingham for the way he handled the situation last Monday. There was a situation which required help from other agencies. LeeAnn Hansen agreed to chair the beautification committee again this year. The planting of the flowers will be on the 15th of May. Need to find flower pots.

Councilman Casey Anderson attended An APPA conference with UAMPS. They learned about cyber hacking, etc. Does the City have in place a cyber hacking policy? With customer information and credit card information, it would really cause a public issue if the City were to get hacked into. It would be a good idea to train the employees. Need to be careful opening emails. Need to have someone follow up on this. We all need to be vigilant in this.

Councilwoman KaeLyn Sorensen thanked the employees for the good job they do. The Council approved the Planning Commission to work on cargo containers. The question is–   has the public been notified of this. Don’t want to get it out of hand. Councilman Casey Anderson asked– does the City actually enforce the ordinances.

Mayor Cox stated that when a complaint is made, the City will proceed at that time. If the issue is blatant, the City does not wait for a compliant.

The float needs to be redone. The weather took its toll on it. Is there any place we can store the float to keep it out of the weather? Open for suggestions. Having to redo the float every year is costly.

APPROVAL OF VOUCHERS:

Councilman Bawb Nielsen moved to approve the vouchers from March 25, 2017 to April 21, 2017. Councilman Cliff Wheeler seconded the motion. The voting was unanimous in favor.
