City Council Meeting Minutes September 17, 2020

Minutes of the Fairview City Council Meeting held on Thursday, September 17, 2020, at

85 South State Street, City of Fairview, County of Sanpete, State of Utah.

Mayor Dave Taylor called the meeting to order at 7:31 p.m. City Council Members present were Mike MacKay, Cliff Wheeler, Matt Sorensen, Casey Anderson, and Brad Welch (due to another appointment attended meeting at 8:20 p.m.). City Employees present were Steve Gray, Greg Sorensen, and Jan Anderson. Citizens Erma Lee Hansen, Rhett Wilkinson, and Jason Mardell were present also. The invocation and Pledge of Allegiance was offered by City Recorder Jan Anderson.

APPROVAL OF MINUTES:

Minutes from August 20, 2020 were approved by motion from Councilman Mike Mackay with a change to be made in Planning Commission Reports. Richard Cox section. Change spring house to say greenhouse. Councilman Matt Sorensen seconded the motion. The voting was unanimous in favor of.

APPEARANCES:

Ron Cox, Frontage Variance Request on Property Located Approximately 25 North 100 West. Mr. Cox is asking the City Council for a two-foot variance on the frontage. He split his property and sold the existing home prior to the request of the variance. The piece north of the existing home is 88 feet by 118 feet. There is enough square footage to build on but lacks the frontage requirement. The fence line has been established for many years. Councilman Matt Sorensen moved to approve the variance of 88-foot frontage. Councilman Cliff Wheeler seconded the motion. The voting was unanimous in favor of (absent at the time Councilman Brad Welch). 

REPORT/ACTION ITEMS – BOARDS/COMMITTEES/STAFF/OFFICERS:

Future Road Discussion/Width of Road Discussion. Mayor Dave Taylor was going through some paperwork when he came across a proposed street plan that was done years back. He presented the proposed roads to the Council for their input. Would like to get an idea on where the Council would like to see through roads go through and have an updated road plan. Development should either be a cul-de-sac or an exit in and out (through street). Mayor Taylor contact Richard Chamberlain, City Attorney, he stated that the City should avoid the cost of any development. Ludlow Engineering stated that a 45-foot road is sufficient. Most roads within the County are 56-feet wide. Current roads in Fairview are 60/66-foot wide. Discussion ensued. It was stated that wider roads are better for burying utilities. Stated that with the 66-foot wide road it allows a rural feel to the City. It was stated that it would prohibit developers, but a benefit to the citizens. In the buffer zone, within one half mile the property owner can have one acre, from a half mile to one mile they are required to have five acres. It is the responsibility of cities to keep the County apprised of their rules. Once the Council comes up with a decision on the roads, it will go back to Planning Commission to incorporate in zoning. The Council is to observe and study this issue and come back next meeting for further discussion. 

Lee Carlston Lot Split on 300 South. Councilman Casey Anderson brought this lot split to the table to have approved. Mr. Carlston would like to split his property into two lots. He has 8.08 acres. He would like to keep the southwest corner where he eventually would like to build a home. Discussion ensued on roads. It was discussed skipping 500 east and continue with 600 east. The lot split meets requirements of 90-foot frontage, lot size 10,000 square feet. Councilman Matt Sorensen moved to approve a lot split. Councilman Brad Welch seconded the motion. Councilman Casey Anderson abstained from voting due to conflict of interest with his profession. Voting in favor of were: Mike MacKay, Brad Welch, Cliff Wheeler, and Matt Sorensen. 

Urban Deer Program Follow-up Discussion. Councilman Casey Anderson visited with Riley Peck with DWR. He said to fill out application and send into DNR. Councilman Casey Anderson moved to fill out application and submit it to DWR. Councilman Brad Welch seconded the motion. The voting was unanimous in favor of.

Carbon Free Power Update. The decision on the application and planning has been extended to October 31st. They are waiting on the Department of Energy.

Discussion of Old Substation Property Located Approximately 45 South 100 East. An

individual approached the City who would like to purchase the old substation property. It is in the flood plan which makes it unbuildable. Mayor Taylor talked to the City employees, they said there is no reason to keep the property. Would the Council be willing to sell the property? Will need to have it appraised and put out to bid. Will need to see what is needed to make sure that the land is cleared of PCBs. May need to have an environmental assessment done, once that is done then the Council will know how to proceed from there. Councilman Brad Welch moved to have an environmental assessment done. Councilman Cliff Wheeler seconded the motion. Voting unanimous in favor of.

INTRODUCTION AND ADOPTION OF RESOLUTIONS AND ORDINANCES:

Ordinance No. 2020-03; An Ordinance Creating a General Policy for Control Backflow and Cross Connections.Tabled until next month to have Council review.

MAYOR REPORTS:

Mayor David Taylor- General City Business Update. The sewer plant lost two pumps and the blower went down. In the motors were repaired. Working on getting help through the CARES Act. Money is being used for upgrading restroom facilities.

APPROVAL OF VOUCHERS:

Councilman Cliff Wheeler moved to approve the vouchers from August 19, 2020 to September 15, 2020. Councilman Casey Anderson seconded the motion. The voting was unanimous in favor of.
