City Council Minutes April 18, 2019

Minutes of Fairview City Council Meeting held on Thursday, April 18, 2019, at 85 South State Street, City of Fairview, County of Sanpete, State of Utah.

Mayor Dave Taylor called the meeting to order at 7:30 p.m. Councilmembers present were Cliff Wheeler, Casey Anderson, Kaelyn Sorensen, Bob St. Jacques, and Sean Rawlinson. Employees present were Justin Jackson, Jeremy Wright, Greg Sorensen, and Jan Anderson. Citizens present were Angela Thompson, Mike Godfrey, Monica Hendry.

Councilman Casey Anderson offered the invocation and led the Pledge of Allegiance.

APPROVAL OF MINUTES:

Councilman Casey Anderson moved to approve the minutes from April 9, 2019. Councilwoman Kaelyn Sorensen seconded the motion. The voting was unanimous in favor of. Councilman Cliff Wheeler moved to approve the minutes from March 21, 2019. Councilman Sean Rawlinson seconded the motion. The voting was unanimous in favor of.

APPEARANCES/COMMUNICATIONS:

Mike Godfrey – Pickle Ball Discussion Update. Mr. Godfrey visited with the principal at the elementary who in turn had been in touch with the district. In the winter, the only day they could use the gym would be Saturdays. Mayor Dave Taylor suggested that go to Mt. Pleasant City and see if they would be interested in running a pickle ball league. Fairview can not supply a supervisor and cover the liability insurance with citizens who want to go to the elementary school to use their gym. In the summer, pickle ball can be played on the tennis courts.

REPORTS/ACTION ITEMS – BOARDS/COMMITTEES/STAFF/OFFICERS:

Planning Commission

Replacement Name for Planning Commission Vacancy. Councilman Bob St. Jacques presented the name of Jason Mardell was presented to the Council for their approval to serve on the Planning Commission. Councilman Bob St. Jacques moved to approve the name of Jason Mardell as Planning Commission member. Councilman Casey Anderson seconded the motion. The voting was unanimous in favor of. Councilman Cliff Wheeler mentioned that he thought Kyle Durrant lived in the County. Councilman St. Jacques will check with Kyle to see where he is living.

Board of Adjustments Update.

The Board consisting of Chair, Ken Bench, Jeff Cox, Jonathan Benson, Ron Giles, and Bawb Nielson will meet next Wednesday, April 24, 2019, week. The City received a variance request.

24thof July Update.The City is working with E-tec getting maps, seats, etc. organized to put on sale. No release date as of yet– maybe mid-May first of June. The schedule has been set. Justin Jackson stated that he had talked to Nathan Miner, the fire department is considering a public firework night in the parking lot at the arena during the 24thof July activities.

Consideration of a New City Attorney. Mayor Dave Taylor stated a lien was placed on Junction Market for non-payment on utilities. Shortly after placing the lien, the City was informed that state statute states you cannot lien on utilities. After talking with two different attorneys, it was suggested that the City change the city billing policy and strike out “the right to claim a lien on all real property”. Today, Mayor Taylor received an email from Craig Smith’s office stating that they had been notified by an attorney representing Junction Market

Fairview, L.C. that the lien was illegally filed and should be lifted. A lot of citizens are paying last month’s bill with next month’s income. The City cannot be a bank, if we lose with Jct. Market, the City will lose $10,000. The City needs to work with citizens and teach that their power will be turned off if delinquent. The Council then discussed the option of looking into using Richard Chamberlain as the City Attorney and agrees moving forward with changing attorneys.

Cemetery Discussion. Mayor Dave Taylor displayed the sign that is posted up at the cemetery. He asked the Council if they would back him if he enforced the rules. There are several trees and bushes that have been planted without any approval. He would like to have them removed. They are growing big and starting to consume to much ground. Mayor Taylor will send out a letter to those who have planted trees and bushes asking them to remove them or the City will go in and take them out. A goal for a future date would be to plant trees all along the edges of the cemetery. Motion was made by Councilman Cliff Wheeler that the City Council will support Mayor Taylor in enforcing the rules at the cemetery. Councilman Bob St. Jacques seconded the motion. The voting was unanimous in favor of. Justin Jackson mentioned that unless a work order is posted, they will not just go and take out bushes or trees at the cemetery.

Water update. Utah water board update 309-511 as of March 1, 2019, it is mandatory that before any water line extension is installed, a hydraulic model will need to be done and certified to the state director. The new proposed line will not impact any other users. The code spells out what will not meet code. The moratorium buys the City time to get our internal online. It is part of a modern master plan needed to update our internal requirements. The City will have to pay for additional hydraulic analyzes. The hydraulic model proves to the State that a new line will not add any detriment to the City. It will not affect any existing water lines. The State has offered $40,000 toward a master plan which includes the hydraulic model. The master plan will cost $50,000 so the City will need to come up with an additional $10,000. Master plans should be updated every five years, the State will give $40,000 each time the plan is updated. Councilman Casey Anderson moved to put an additional $10,000 to be included with the grant and matching funds. The money will come from the PTIF water account. INTRODUCTION AND ADOPTION OF RESOLUTIONS AND ORDINANCES:

Resolution No. 2019-03R; Imposing a Temporary Moratorium on New Waterline Extension(s) within and out of the Corporate Boundaries of Fairview City. Councilman Bob St. Jacques moved to approve Resolution No. 2019-03R.  Councilman Cliff Wheeler seconded the motion.  The voting was unanimous in favor of.

COUNCIL REPORTS:

Mayor Dave Taylor –General City Business. A few more water meters are left to put in the ground. He gave the Council a water rate worksheet for the last four months for those water users on an auto read meter. The City’s current base rate is 8,000 gallons per month at $28 per month for city residents and $34 per month for outside city residents. Would like the Council to come back next month for a discussion on water rates. Three thousand sandbags were ordered along with sand in case of any flooding from the spring runoff.

Councilman Cliff Wheeler mentioned that anyone who would like to plant flowers in the pots that are placed along State Street are welcome to come to Skyview Nursery in Centerfield at 5 p.m. the Monday after Mother’s Day. If anyone sees a dog without a current dog license, please report them to the City so that the owner can be notified that they need a current dog tag.

Councilman Casey Anderson stated that a while back, a utility open house day was discussed, wondering if the Council had a date they would agree on. Decided that a Saturday would work best. May want to open invitation to irrigation company to do a booth, etc. Cook hot dogs and tie in with a community service project day. UAMPS can come down in July and give a quick update(s) on power project developing. Will have information next month on small cell towers for the Council to approve. An ordinance will need to be approved. City Council meeting will held July 11thdue to the celebration.

APPROVAL OF VOUCHERS:

Councilman Cliff Wheeler moved to approve the vouchers from March 20, 2019 to April 16, 2019. Councilwoman KaeLyn Sorensen seconded the motion. The voting was unanimous in favor of.
