City Council Minutes March 15, 2018
Minutes of Fairview City Council held on Thursday, March 15, 2018, at 7:30 p.m. at 85 South State Street, City of Fairview, County of Sanpete, State of Utah.
Mayor David Taylor called the meeting to order at 7:30 p.m. Councilmembers present were Cliff Wheeler, Casey Anderson, Mike Jarman, Bob St. Jacques, and KaeLyn Sorensen. City employees present were Justin Jackson, Garrett Sorensen, Jeremy Wright, Greg Sorensen, and Jan Anderson. Citizens present were Jennifer Stewart Gray, Kristann Gillies, Homer Morrill, Ashlee Morril, Mike MacKay, Jason Mardell, Dan Brinkerhoff, Jackson and Charlot Pemberton, and Erma Lee Aaron.
Councilmember Mike Jarman offered the invocation and led the Pledge of Allegiance.
APPROVAL OF MINUTES:
Councilmember Cliff Wheeler moved to approve the minutes from February 15, 2018. Councilman Mike Jarman seconded the motion. The voting was unanimous in favor of.
PUBLIC HEARINGS/APPEARANCES/COMMUNICATIONS:
Miss Fairview Introduction. Miss Fairview 2018 Queen is Malia Ah Kuoi, daughter of Sarah Noorlander and William Ah Kuoi; first attendant is Allyssa Ericksen, daughter of Jeff and Annette Ericksen; and second attendant is Emily Kerksiek, daughter of Amber and Scott Kersiek. Allyssa was unable to attend council meeting, she was competing in the region sterling scholar competition.
Kristann Gillies – Proposed Development of Five Homes and Interactive Farm, Booths, Corn Mazes, etc. Kristann met with the Mayor Taylor prior to the meeting and he suggested that even though she is in the County come to council meeting and brief them on her development. Kirstann purchased the Clyde Mortensen’s ranch. Her children would like to live here. She has deeded property to them west of her home. There is a road easement for these homes. She has met with Scott from the County. The County will improve the road. The cost will be around $32,000 to $35,000. Leon Day owns the property west of where these homes are to go in. If she pays the road, Leon will give her water. She is not planning on developing the rest of the property. Her plans are to put in a business with a pumpkin patch for a little kids kind of like an event center, a child friendly place– a corn maze, booths, dutch oven meals, haunted ranch for date nights, bow tag, air soft gun games, along with paint ball events. Eventually she would like to open the pond up to fishing and hunting. Also, providing wedding facilities, etc. Whe hopes to be able to turn the white sheds into bunk houses. There will be porta potties brought in and ultimately having restroom facilities. She would like to have some of her events ready by this fall. Her vision is a five-year business plan. Access to and from the event area along with parking have been addressed. She has met with the County and looks to be able to move forward. Invited her to come in because the City is her neighbor, and this will affect the City and is an asset to the City. There is City water up Day Lane but not sure if the water pressure is sufficient. There is the issue of is there enough water to provide fire protection. She has water rights to drill a couple of wells and put in septic tanks but does not want to go to all that expense if the City is going to upgrade the water up Day Lane.
City Employee Justin Jackson took time to explain what would have to happen in order to get water up Day Lane. If this area develops and there are eight homes or more that go in, then State statute comes into play. A new line would have to be put in along with fire hydrants. The question is– does the Council want to invest in this area, if so they may want to upgrade the water and do things right the first time? Elevation is a key player. Cannot give a cost estimate until the elevation is determined. A study would need to be done to determine the elevation and what would be needed to provide water, not sure if a pump would need to be put in.
A study cost estimate would be around $10,000 with a couple of options– with or without a pump. Some of the land out in that area have been zoned differently by the County, some are one-half acres, some are acres, and some are one- and one-half acres. Some questions to address are what is the service area going to be, does the City have enough water supply to do the initial project? The City has water permit for 2300-acre feet and only 13 percent is being used which equates to 350- acre feet. What the City does not have is the facilities to pull out the water they have. When the City grows then the master plan will need to be upgraded. Have-to have x-number of gallons in storage, at a minimum need to have another tank installed. Growth will happen sooner than later. A couple of wells are inactive, if the summer is dry, then the City will need to put the wells back in to operation. Councilman Cliff Wheeler asked how does the City come up with the $10,000? There should be money in the budget that has not been used elsewhere. Just a rough guess on the cost to replace the line range from $37 to $60 per foot so high-end estimate $600,000 low-end estimate $230,000. There are revolving funds where you can consolidate the loans but will need to add additional money to the loan. Councilman Bob St. Jacques asked if the City were to annex Krisann Gillis in then would it not leave an island. It was stated that if annexation happened then you would see the rest of the property owners come in also. The City is not pursuing the annexation currently.
Krisann Gillies stated I hate to put in well and septic tank to not have them. It is wasted money. And then eventually get hooked on to the city.
Citizen Dan Brinkerhoff stated that if you run water then you in turn will have to run the sewer back. It’s a double cost of the project and another concern is the road. Someday the City will have to either bow to development or not. Don’t know if you have grants. Need to go slow enough before it gets out of control. To spend money, we don’t have to put burden on the citizens. A health concern because of the dust. Help with putting a speed sign of 25 mph. In all of this, the City should be involved with this, etc.
It was suggested that a motion be made to move forward with the study so that the City has an idea on what the project would entail. Councilman Mike Jarman moved to have Horrocks Engineer proceed with a study regarding upgrading the water system up Day Lane. Councilman Bob St. Jacques seconded the motion. The voting was unanimous in favor of. (Put on agenda for next month for a formal motion since this item was not on the agenda.)
Charlot Pemberton – Fairview Economic Development is Proposing a Farmer’s Market.
She is ready to tackle another community event. She has invited some people that like to raise a garden to participate. There a many people who cannot grow a garden at this time but would like to have fresh produce. She held a meeting where ten people attended. They formed a committee of four to make decisions and look into what other cities have done and to come up with a location. Charlet in the meantime visited with Mayor Dave Taylor and came up with the idea of using the ground north of the Dance Hall by the gazebo going east along the fence line. There is space for potentially 35 venters (10×10 space). They are planning on having music and live music when they can get it. There is grant money available through the arts council, etc. for quest artists. She has come up with a fee schedule for her venders. The fee is for space rent is $5 per Saturday. The event would be from 9 a.m. to 1 p.m. every Saturday staring sometime in June to October depending the weather running 20 weeks. She plans on having a section for children under 12. There will be sandwich advertising. Sue Rasmussen is helping her with this. Would like to have a banner across the canyon road also, advertise by radio and facebook. The cost is $300. She is looking for sponsors. If vendors hook into power, then it would drain the City. They are to bring in their own generators. They are to clean up after themselves.
Mayor Taylor offered the City dumpsters for their use. Councilman Cliff Wheeler asked if more than produce would be sold—yes. Do the vendors have their food handler’s permit– yes they must be registered before they are issued a permit to sell here. There is a food vendor truck planning on coming. Trying to get Harwood farms to come participate. Waffle Love may come in. Councilman Wheeler asked when there are weddings in the Dance Hall and they want to use the gazebo for pictures, will there be a problem with that– should not be. Will art be sold? Artists are hesitant to brink art work out in the weather. Using the Dance hall has been discussed and decided that the Dance Hall could not be committed for a location. Councilman Mike Jarman asked if this area started getting congested would they be willing to move it– yes. He would like to see the vendors moved more to the east. Jason Mardell who is on the committee stated that they have looked at other places like the rodeo grounds but felt that the market needed to be in a central location. Councilwoman KaeLyn Sorensen has a concern with the location. Councilman Casey Anderson has a concern with them using City property. Councilman Bob St. Jacques moved to allow Charlet the use of the ground north of the Dance Hall and east of the gazebo along the fence line to 100 East for Farmer’s Market this summer. Counclman Cliff Wheeler seconded the motion. The voting went as follows: for– Bob, Mike, and Cliff; against– KaeLyn Sorensen; Councilman Casey Anderson abstained. If there is a situation that comes about, then the City Council will readdress the decision.
REPORTS/ACTION ITEMS – BOARDS/COMMITTEES/STAFF/OFFICERS:
Power Department.
Discussion on Power Purchase Contract for Carbon Free Power Projects. Councilman Casey Anderson stated that a decision will need to be made by the Council month on whether to continue with this project or not and how much involvement do they want the City to participate in. This project is ten years down the road—2026 or 2027. There are government subsidies available if the Council wants to go in that direction. This is a nuclear project. There are a lot of opposition from other federal organizations. This project is on government owned property, hoping to have the federal government as a partner in this. Does the Council want to be briefed by UAMPS before they make their decision? Need to decide how much they want to be involved and how much nuclear power does the City need. Casey will visit with UAMPS next week to go over Fairview City’s needs. Plan on a discussion and a vote will need to be taken in this matter.
Update on Building Setback for Property Located at 115 North 100 West. This shed has been red-tagged by the County. The shed is too close to the property line. A cement floor will be poured so the pad meets the setbacks and then the shed will be moved and placed on the floor. No date has been set at this time.
Update on Trailer Park Located at 200 South 15 East. Trent Porter purchased the trailer lot from Ken Bench. Trent has been in the City offices several times. He is working on getting titles to the trailers, so he can have them removed. There is a dumpster there to help with cleaning the lot. The answer we have is not the best but that is what the City has been dealt with.
Discussion on Wage Salary. Mayor Dave Taylor prepared two pages recapping the wage study done by Jerry Nelson. Our City employees come in between the minimum and mid-point. Would like to start moving employees to the midpoint. Would like to use these numbers to start working on the budget.
Schedule Budget Work Meeting. April 4, 2018 at 6:30 p.m. at the City Hall.
Annual Open Meeting Review. The review was given by City Recorder Jan Anderson.
Note: Annual Easter Egg Hunt Scheduled.
COUNCIL REPORTS:
Mayor Dave Taylor stated that lawn equipment is being serviced. The roads are being crack seal and hoping to start chip sealing in the next month or two. An ad has been placed for a new employee to replace the vacancy the City has.
Councilman Casey Andersonasked if anyone was planning on attend the League of Cities and Towns meeting in St. George, the dates are April 25 through the 27th. He suggested that someone should go.
Councilman Mike Jarman stated that he met with the National Guard for two reasons- get color guard for events and with ball fields. They stated that they are ready to do the excavation but are waiting on the City. They have not received the survey. Some of the confusion came from that fact that the guard was deployed. If the City had turned in the survey, they could have turned it over to another agency. They could have had this done in a weeks’ time if they have the equipment. Now it will take three months. Leon Day created the survey. Mayor Taylor will reach out to him and get the survey. Councilman Jarman will hand carry the survey to them.
APPROVAL OF VOUCHERS:
Councilman Bob St. Jacques moved to approve the vouchers from February 13, 2018 to March 13, 2018. Councilman Cliff Wheeler seconded the motion. The voting was unanimous in favor of.
EXECUTIVE SESSION FOR PERSONNEL MATTER:
Councilwoman KaeLyn Sorensen moved to go into executive session at 9:28 p.m. Councilman Bob St. Jacques seconded the motion. The voting in favor of—Cliff Wheeler, Casey Anderson, Mike Jarman, KaeLyn Sorensen, and Bob St. Jacques.
City Council reconvened back in to regular session at 9:50 p.m. No other official business was discussed.

Councilman Bob St. Jacques moved to adjourn meeting at 9:51 p.m. Councilwoman KaeLyn Sorensen seconded the motion. Motion carried.

Minutes of executive session held on Tuesday, January 18, 2018, at 9:30 p.m. in the council room of the Fairview City Hall, 85 South State, Sanpete County, State of Utah.
Those present were Mayor Dave Taylor and Jeff Cox along with Council Members
Cliff Wheeler, Casey Anderson, Kaelyn Sorensen, Bob St. Jacques, and Mike Jarman.
I, Mayor Taylor, do swear that the purpose of the executive session was to discuss a personnel matter.
