City Council Meeting Minutes May 23, 2017
Minutes of Fairview City Council Meeting held on Tuesday, May 23, 2017, at 8:00 p.m. at 85 South State Street, City of Fairview, County of Sanpete, State of Utah.
Mayor Jeff Cox called the meeting to order at 8 p.m. Council Members present were Bawb Nielsen, Cliff Wheeler, Casey Anderson, Kaelyn Sorensen, and Bob
St. Jacques. City Employees Dave Taylor, Jan Anderson, Gregg Sorensen, Bob Bingham, Justin Jackson, and Garrett Sorensen were also present. Citizen present Mary Cox, Cliff Keller, Roman and Erma Lee Aaron, Alyson Lee, Mike Jarman, Jared Livingston and Rae Lohmeyer, and Fred Johnson.
City Employee Jan Anderson offered the invocation and led the Pledge of Allegiance.
APPROVAL OF MINUTES:
Councilman Cliff Wheeler moved to approve the minutes from April 25, 2017. Councilman Bawb Nielsen seconded the motion. The voting was unanimous in favor of.
APPEARANCES/COMMUNICATIONS:
Mary Cox, Report on Event Held at Dance Hall in April. Mary used the dance hall on April 29, 2017, for a fund raiser. April is autism awareness month. The Fund raiser was to offset expenses for attending the school in American Fork. The fundraiser was successful. She asked the Council if they would be willing to waive the fee. The Council decided that the use of the building for a fundraiser was for a noble cause. Councilman Bawb Nielsen moved to waive the fee on the Dance Hall for Mary Cox. Councilman Bob St. Jacques seconded the motion. The voting was unanimous in favor of.
Jared Livingston, Propose Idea to Maintain Sports Park. Jared would like to adopt a park. The idea came from his daughter. They were visiting the Iven Cox park and it was full of weeds and trash. His daughter said they should clean the park. That is where the idea came from. The idea of adopting a park program offers neighborhood groups, community organizations and local businesses a way to help enhance the appearance, safety, and cleanliness of the parks. The benefit to the City is the parks are clean, it frees up employee time, and there is zero cost. The responsibility of the adoptive group is they pick up the trash and litter, they pull weeks and rake the bark or sand, they sweep the hard services, report any vandalism, unsafe conditions and needed repairs. The pros to both are community involvement, serves as a team-building, and signage at the park. This would be no cost to the City. It was suggested to create a policy and take to the businesses to see if they are interested. The Council liked the idea. It was suggested to have it put in the Focus and to create policy. The Council will get back with Jared. He mentioned that he has someone who could help with signage.
Fred Johnson, Discussion Cooperative Agreement with Utah Division of Forestry, Fire, and State Lands. This is not a required agreement, but allows municipalities a resource to do in-kind participation with the State of Utah to cooperatively discharge their joint responsibilities for protecting non-federal land from wildland fire. The issue is that fires can become an expensive game. The cost to fight a fire is broken out by acreage. This agreement helps the State of Utah reduce the risk of fire. This agreement is to continue for five years from the date of the last authorized signature and may only be amended by mutual written agreement of the parties. Within two years of signing this agreement, a Community Wildfire Preparedness Plan or an equivalent wildland fire preparedness plan will need to be adopted. The fire department must meet minimum standards for wildland fire training. The fire department will be responsible for initial attack. The City will be responsible for all initial attack costs except aviation. For 2017, the City’s in-kind responsibility is $1,049. The City is responsible each year to help with fuel mitigation, wildfire prevention, and wildfire suppression in and around the City. If there were a bad fire within the City, and the City could meet their financial responsibility, then the County would help with the cost of fighting the fire. Councilman Bob St. Jacques moved to participate in this cooperative agreement with the State of Utah. Councilman Casey Anderson seconded the motion. The voting was unanimous in favor of.
REPORTS/ACTION ITEMS – BOARDS/COMMITTEES/STAFF/OFFICER:
Planning Commission
Council Input on Revision of Table 11-1, Residential Development Standards, Accessory Structures. The Planning Commission had the City Council review their proposed change on the above noted. Councilwoman KaeLyn Sorensen stated that she did not like the idea of allowing cargo containers at all. It was asked if it were better to look at a trashy yard then a container that hides the debris. The Planning Commission agrees that there is an issue with containers and that it is better to have something on the books to help regulate them. It was stated that the City has a couple of cargo containers, and as of now, they are in violation. Councilman Bawb Nielsen stated that in reviewing the proposed change, the last line is confusing– rented or leased agreement. This supersedes the purpose of revision with that one sentence. The reason for that sentence was, if a person rented a container, and it had the business logo on it, and the agreement was to leave it on. Councilman Casey Anderson stated there needs to be a timeframe which states when the homeowner must have it painted. The containers should not be allowed to be grandfathered in.
Power Department
Kearn River Waste Heat Recovery Project. Councilman Casey Anderson stated that in the future, the City will have the opportunity to participate in purchasing power from power plants that generate power off friction from gas lines. It creates heat without a turbine. The cost is very economical. This is still a few years down the road.
Approval to Apply for the “Utah Outdoor Recreation Grant”. This grant will help fund the sewer pump and line at the Sports Park – $74,000. It is a matching grant. The City has applied with the national parks which will help with half. The two will work together. This is a chance that may not happen again. Councilman Bawb Nielsen moved to apply for the Utah Outdoor Recreation Grant. Councilwoman KaeLyn Sorensen seconded the motion. The voting was unanimous in favor of.
Tentative Budget Approval for Budget Year Ending June 30, 2018. Mayor Cox recommended a cost-of-living increase for the employees. Councilman Casey Anderson asked where the money would be coming from. The City needs to start cutting back. It was suggested that a budget work meeting be held and adjust numbers. Councilman Bob St. Jacques moved to approve the tentative budget for fiscal year 2018. Councilman Bawb Nielsen seconded the motion. The voting went as follows: In favor Bawb Nielson, Cliff Wheeler, Casey Anderson, KaeLyn Sorensen, and Bob St. Jacques.
Set Public Hearing Date for Final Budget Approval for Budget Year Ending June 30, 2018. Because of the property tax increase the public hearing will need to be the first part of August. Councilman Bawb Nielsen moved to hold the budget hearing on August 8, 2017, in conjunction with city council meeting starting at 7 p.m. This will include the public hearing on the transfer of enterprise funds. Councilwoman KaeLyn Sorensen seconded the motion. The voting was unanimous in favor of.
Approve Sanpete County Fire Protection Agreement. This year’s portion of the fire protection agreement is $12,019.01. Councilman Bawb Nielsen moved to approve the agreement. Councilman Cliff Wheeler seconded the motion. The voting was unanimous in favor of.
Note: Declaration of Candidacy begins June 1st through the 7th.
Note: Flower Must be Removed Monday, June 5th from Cemetery. Councilmembers are encouraged to help (8 a.m.).
COUNCIL REPORTS:
Mayor Jeff Cox – General City Business Update. Mayor Cox thanked the employees for all their work they are doing. He stated that Thursday night (May 18th), a clean in place was done at the sewer plant and replaced a cassette with a new one. A couple of lawn mowers broke down. A new lawnmower was purchased from Cox Automotive. Payment will come out of next year’s budget.
Councilman Cliff Wheeler stated that the flower pots were planted. They had a good time and a few new people came and helped. The flowers will need to be picked up when it turns warm.
Councilman Casey Anderson stated that Lee R. Sorensen purchased a used baseball pitching machine from the high school. A few parts are needed to get it up and running. Pretty excited about it. Appreciated getting the sports park mowed and watered.
Councilman KaeLyn Sorensen stated she drove by the cemetery and expressed her thanks to the employees for their work. Cheryl Swapp is spear heading the rodeo queen pageant, she is also chairing the horse parade.
Councilman Bob St. Jacques. The corner station is back on face book, it is changing it to the station deli and craft mall. It is nice to see some action there.
APPROVAL OF VOUCHERS:
Councilman Casey Anderson moved to approve the vouchers from April 22, 2017 to May 18, 2017. Councilman Bob St. Jacques seconded the motion. The voting was unanimous in favor of.
EXECUTIVE SESSION:
Councilman Bob St. Jacques moved to go into executive session at 9:15 p.m. Councilman Casey Anderson seconded the motion. All in favor– Bawb Nielson, Cliff Wheeler, Casey Anderson, KaeLyn Sorensen, and Bob St. Jacques.
Reconvened into regular session at 10:00 p.m. No business was conducted.

Minutes of executive session held on Tuesday, May 24, 2017, at 9:15 p.m. in the council room of the Fairview City Hall, 85 South State, Sanpete County, State of Utah.
Present were Mayor Jeff Cox along with Council Members Bawb Nielsen, Cliff Wheeler, Casey Anderson, Kaelyn Sorensen, Bob St. Jacques, and City Recorder
Jan Anderson.
I, Mayor Cox do swear that the purpose of the executive session was to discuss a personnel matter.
