City Council Minutes August 22, 2019

Minutes of Fairview City Council Meeting held on Thursday, August 22, 2019, at 85 South State Street, City of Fairview, County of Sanpete, State of Utah.

Mayor David Taylor called the meeting to order at 7:34 p.m. Council members present were Cliff Wheeler, Casey Anderson, KaeLyn Sorensen, Bob St. Jacques, and Sean Rawlinson. City employees present were Logan Ludvigson, Justin Jackson, Greg Sorensen, and Jan Anderson. Citizens present were Ramon and Erma Lee Aaron, Mike Mackay, Ed and Peggy Underwood, Scott Mower, Matt Sorensen, and Shuana Rawlinson. Reporter James Tilson.

APPROVAL OF MINUTES:

Councilman Cliff Wheeler moved to approve the minutes from June 20, 2019, amended as stated. Council Bob St. Jacques seconded the motion. Voting was unanimous in favor of. Councilwoman KaeLyn Sorensen moved to approve the minutes from July 11, 2019, as amended. Councilman Sean Rawlinson seconded the motion. The voting was unanimous in favor of.

REPORT/ACTION ITEMS – BOARDS/COMMITTEES/STAFF/OFFICERS:

Planning Commission

New Member Approval. Councilman Bob St. Jacques mentioned that he had visited with a member of the Planning Commission. This individual has not been attending meeting(s) leaving the Planning Commission without a full quorum. The member committed to be more vigilant in attending. Councilman St. Jacques stated that he had talked with Heidi Williams. He asked her if she would be willing to serve on the Planning Commission. Councilman Bob St. Jacques moved to approve Heidi Williams as a member of the Planning Commission. Councilman Sean Rawlinson seconded the motion. The voting was unanimous in favor of.

24th of July Update. Next year the 24th of July is on a Friday. Need to have an idea with what days the Council would like to hold the events on. Councilman Sean Rawlinson mentioned holding the derby on Saturday and the rodeo on Friday. The Mayor asked the Council to come back next month with some ideas for further discussion. Councilman Sean Rawlinson expressed his appreciation to the City employees and volunteers for their hard work, it was a great success.

Urban Deer Discussion.  Councilman Casey Anderson stated he has had a lot of citizens approached him and wanted to know what to do with the deer population in town. Division of Wildlife Resources (DWR) when contacted mentioned that they do not own the deer so more or less, fence off your property and utilize other alternatives. There is a problem. Other cities are having the same discussion. DWR would like the City to pass an ordinance that states do not feed the deer. It was mentioned that people are encroaching on their living space. This is a rural area. Some cities have done archery hunts in their cities. Not everyone wants to see the deer killed. Unkept yards and/or abandoned houses seem to entice the deer, need to work on these properties. It was suggested to put a note in the Focus giving information to the citizens that there are options to help with the deer problem one of those being plant shrubs and plants that deer will not eat. It was mentioned that these deer that are in town now are those deer that were born here in town, so they know no different. Consensus was to look at creating a no feed ordinance and enforce unkept yards. Councilman Casey Anderson was asked to contact other cities and then report back with what he finds the other cities are doing with deer.

Community Gathering Fair. Would like to move this back to the 21st of September instead of September 7th. Citizens or whomever are invited to come and tour the sewer plant, power substation, and breaker/switch station beginning at 10 a.m. and ending at noon with a barbeque at the City park where hot dogs will be served. The fire department and EMT’s are invited to participate with a booth at the park.

Home-Occupation Permit Process Discussion. Recorder Jan Anderson would like to have the approval of the Council to investigate approving Home Occupation Permits through the office by passing the Planning Commission and City Council. The ordinance would need to be amended. There would need to be some clarification on permits that maybe simple versus complex. The Council gave approval to investigate changing the ordinance to help applicants expedite the process. When ready bring back for the Council to review.

Water/Sewer Department

Sewer Reuse Project Update. Horrocks Engineering met with Mayor Taylor and Justin Jackson. The Mayor signed the task force so they can now move forward with specific details. The direction has changed somewhat. Scott Mower President of the City Ditch Irrigation Company came to the City with an idea of providing pressurized irrigation water to the citizens on the west side of town. This would eliminate the pressure off the well as well as the wastewater plant. There are a lot of legal hurtles that will need to be jumped through. Mayor Taylor asked if the Council would support moving forward with combining the City Ditch water with the sewer reuse project. It was asked if there was a cost estimate–  currently, no. Need approval to even go that far. It was asked how does this work together? Modular will have to be expanded along with the location of the tank. Both the reuse water and the irrigation water will be contained in the same tank and then dispersed. The tank size may need to be changed. As the water increases, then more tanks will need to be added and placed at a higher elevation. The proposed tank now deals with very limited area.

Scott Mower stated that the irrigation water comes into town on 200 West and that is where the water is adjudicated at. The sewer reuse water must be used on areas within the City. This is where the legal aspect comes in. A feasibility study could cost around $15,000, it was asked if the irrigation company would be able to put up the money for the study. Scott stated that the State would like to see this happen. There is a lot of money allocated to close open ditches. By marrying the two together, this would allow a better chance for money. Most citizens on the west side of town would love to have the water. Once the numbers are figured out then of course it will have to go back to the irrigation stockholders. It was asked if the Council would support the idea of exploring this idea. Councilman Cliff Wheeler moved that the City Council give permission for the City to explore hooking up with the City Ditch Irrigation Company to do the sewer reuse project. Councilman Casey Anderson seconded the motion. The voting was unanimous in favor of.

Spring Line Update. City Employee Justin Jackson stated the repair on the spring ling was completed last Friday. Went through a disinfection state and met all State requirements. Water is now flowing into the tank. The flow rate is good and bad. This is no longer part of an EQWA grant. The flow is not where it needs to be at this point. The flow is 65 gallons a minute. Not ready for the public to start utilizing a lot of water, need to wait for the tank to fill. The SCADA project is done. All water sources are now online with alarms, etc. The original spring line bid was $45,000, was able to do the repair for around $21,000. Another repair is needed on the spring line, there is a section where the white pipe is out of compliance. The City has enough pipe to go in and fix it. The water department will now be audited every three years per State law. In the audit, the City will be dock points for those things at are not up to code. You are allowed 150 points. The audit is scheduled for September 4th. The emergency response plan needs to be updated, expect to be written up on this.

Power department. City Employee Greg Sorensen mentioned that a few power blinks, they have been caused by birds. UAMPS has provided us a program to help with this. It is a rapture project. We are starting to put them up. The pole retro fit is part of the Horse View Wind Project. We are trying to be good stewards. Part of that project and this project is geared towards big birds.

INTRODUCTION AND ADOPTION OF RESOLUTIONS AND ORDINANCES:

Resolution No. 2019-12R: A Resolution Authorizing the Red Mesa Tapaha Solar Project Transaction Schedule Under the Power Supply Agreement with Utah Associated Municipal Power Systems and Related Matters. We elected to pursue to be involved with the solar system. We are at the point where this resolution needs to be passed to move forward. The City asked for the most that they will give us in shares. Gives us agreement with UAMPS to move forward in the exploratory stage. Fairview City is the smallest town involved in this 142 kw. Councilman Casey Anderson moved to accept this Resolution No. 2019-19R. Councilman Cliff Wheeler seconded the motion. The voting was unanimous in favor.

COUNCIL REPORTS:

Mayor David Taylor – General City Business Update. Stated that he appreciated the City workers and thanked them for the good work that they do.

Councilman Cliff Wheeler mentioned that in last Council meeting it was brought up that several manhole covers had been covered, wondering if anything had transpired. The manholes were uncovered, and no further action is required. Also, wondering about the ballpark. Justin stated that they have been working on updating the culinary side with a meter and a backflow preventer. It will then be hooked up to irrigation water. The City will then have the option of using either culinary or irrigation water. It will take time to finish it due to the many other projects that need attention. Like to have it done by Spring. The fields need to be leveled and hydroseeded.

Is there a deadline on construction when they start to finish? The building permit is for one year. They can come in and ask for an extension. Concern is the southwest back of the City, one lot has a storage container, trees are growing up the side of the roads and the grass is so high that you can’t see to drive. There is so much stuff on the side of the road by the house that still isn’t finished. Mayor Taylor stated that he had talked to John Lee regarding the weeds, he will come and chop them down. We are in the process of hiring an enforcement officer which help in monitoring these issues.

Councilman Casey Anderson stated that he is in the process of getting the power rate study proposal, hoping to have more information for next meeting. UAMPS is having a tool training, should get an invite shortly. He also expressed appreciation with the 24th, and the future youth city council step up and help with the concession.

UAMPS is looking into making some changes with the smart energy and rebate program. May want to put in Focus, will need to get more information from UAMPS.

Where are we on the road with chip seal. Mayor Taylor the roads may need to be put on hold because of spring line. Need to investigate what money is available. Like to look finishing the west side if the City can financially to this.

In preparation of the open house there needs to be some serious work done at the sewer plant to get it ready. Maybe Cade Wright our seasonal help could work on this.

Councilwoman KaeLyn Sorensen stated she is working on youth city council hoping to introduce them next month.

Councilman Bob St. Jacques stated that he is thinking about putting an ordinance together authorizing the Mayor or the council member over it to act as an alternative when there is not a full quorum. Councilman Cliff Wheeler stated that if they vote as a commission member then they cannot vote on it twice when it comes to City Council, not sure that it is appropriate. They are supposed to work independent. Councilman Sean Rawlinson agreed.

Councilman Sean Rawlinson stated that the 24th celebration was a success, great committee members, and great help from the City employees. Just appreciate all the help everyone including our volunteers.
